[Thai Supreme Court Rules Bitcoin is "Property" Under Criminal Law] Golden Finance reports that on October 28th, the Thai Supreme Court, in its judgment No. 4929/2569, ruled that Bitcoin constitutes "property" in criminal cases. The case involved a defendant prosecuted by the Koh Samui Public Prosecutor's Office. The victim converted US$50,000 (approximately 1.878 million Thai baht) into Bitcoin and transferred it to a criminal gang. The court found the elements of a property crime to be met. The reasoning was that Bitcoin has value according to market prices, can be exchanged for cash when there is a buyer, and can be held by ordinary people; therefore, it is not a worthless or intangible object, and its value is not destroyed by converting cash into Bitcoin. The judgment also pointed out that the Bank of Thailand's position that cryptocurrencies are not legal tender is a separate issue from whether it constitutes "property." The judgment cited Article 137 of the Civil and Commercial Code and Articles 309, Paragraph 2, 340, Paragraph 1, and 340-3 of the Criminal Code.
