[CFTC and Department of Justice Sue Utah to Block State Gambling Law from Cracking Prediction Markets] According to DeFi Rate, on October 28th, the U.S. Commodity Futures Trading Commission (CFTC) and the Department of Justice filed a lawsuit on October 26th against the state of Utah and its Attorney General, Derek Brown, seeking preliminary and permanent injunctions to prevent the state from using its gambling laws to crack down on federally regulated prediction markets. The lawsuit states that Utah's enforcement "could completely eliminate the operation of CFTC-regulated exchanges in the state" and warns that fragmented state regulation would result in "50 regulators." Previously, on October 20th, Utah sued Kalshi and two Susquehanna entities, alleging that Kalshi collected approximately $30.6 million to $61.2 million in fees from users in the state; in August, a federal district court ruled in favor of Utah, and the Tenth Circuit Court of Appeals granted Kalshi an emergency injunction during the appeal process. Utah is the 10th state to which the CFTC has filed a lawsuit.
