[New York State Gaming Commission Sues Kalshi, Seeks Court Enforcement of Subpoena] According to Jinse Finance, on October 23, the New York State Gaming Commission filed a lawsuit with the New York County Division of the New York State Supreme Court, seeking to compel Kalshi to comply with an investigative subpoena issued on July 31 under Section 104(7) of the state's horse racing law. The subpoena covers sports event contracts, businesses targeting users under 21, advertisements describing products as betting, and equity and corporate structure. The Commission stated that this move aims to determine whether and how much civil penalties should be imposed on Kalshi and other entities; Kalshi has not yet publicly responded. Previously, the New York State Attorney General and Governor sued Kalshi on July 31, seeking at least $36 billion in damages; Federal Judge Torres rejected Kalshi's preliminary injunction request on July 7. The appeals courts are divided: the Third Circuit supports Kalshi, while the Ninth and Sixth Circuits support state regulation.
