DEF supports the investment contract safe harbor in the SEC’s proposed Regulation Crypto Assets and asks the Commission to ensure that it is available to existing networks and protocols. The final rule should also confirm that ongoing development after a network is functional does not, on its own, constitute essential managerial efforts. The proposed Safe Harbor is a significant step toward the regulatory clarity developers and users have long sought.
