[U.S. Federal Judge Approves Kalshi and Coinbase's Preliminary Injunction Against Illinois]
According to a report by DeFi Rate on October 2, U.S. Northern District of Illinois Federal Judge Martha M. Pacold partially approved the preliminary injunction request from Kalshi, Coinbase, and the U.S. CFTC on October 2. The injunction prevents Illinois from applying its sports betting license requirements and related criminal provisions to Kalshi's listed contracts involved in the case, ruling that such contracts are likely swaps as defined under the Commodity Exchange Act and fall under the exclusive jurisdiction of the CFTC. Pacold wrote, 'A swap is a swap, whether or not it is used for gambling.' Challenges to Illinois transaction fees (including newly added prediction market transaction fees) remain subject to further briefing. This ruling creates a split within the Seventh Circuit, contrasting with a prior opposing decision by a Wisconsin court, which has already been appealed to the Circuit Court of Appeals.
