The U.S. District Court for the Middle District of Florida issued a default judgment in the Fundsz digital assets and precious metals fraud case against Brian Early and Alisha Ann Kingrey, ordering them to pay over $30 million in fines. The court found that, as members of the Fundsz board and Telegram group admins, the two made false statements about expected returns, historical trading performance, and loss risks. They also falsely claimed that investors' funds could be traded using a 'proprietary algorithm' and withdrawn with principal and interest. After learning of the CFTC investigation, the two began retracting their previous profit promises and attempted to erase Fundsz's social media presence. On the same day, the court also issued consent orders against two other individuals involved in the case, including Juan Pablo Valcarce, who was permanently banned from having others trade crypto assets or precious metals on his behalf and prohibited from further violating CFTC regulations.
