[Canada's Financial Regulator OSFI: Tokenized Deposits Have the Same Legal Nature as Traditional Deposits]
Canada's financial regulator OSFI issued a statement saying that under the legal framework for federal financial institutions, it adopts a technology-neutral stance toward financial innovation. The legal nature of financial products and services depends on 'what they are,' not 'how they are implemented.' OSFI explicitly stated that tokenized deposits are legally no different from traditional deposits. The statement emphasized that financial institutions and their third parties must comply with existing laws, regulations, and guidelines such as B-13 'Technology and Cyber Risk Management' and B-10 'Third-Party Risk Management' when launching innovative products, including tokenized and other digital deposits. Furthermore, they must proactively communicate with regulators and obtain appropriate legal advice before introducing any new products or services.
