Hyperliquid Policy Coalition (HPC) submitted an amicus brief to the U.S. District Court for the District of Columbia, supporting the CFTC's motion to dismiss CME's lawsuit against perpetual futures on U.S.-regulated exchanges. HPC stated that in May this year, the CFTC allowed Kalshi to launch Bitcoin perpetual futures and confirmed that U.S. derivatives exchanges could list similar digital asset perpetual contracts. CME subsequently filed a lawsuit challenging this decision. HPC argued that CME failed to demonstrate any actual harm caused by the CFTC's decision, thus lacking standing to sue, and noted that preventing competitors from launching innovative products is not an interest protected under the Commodity Exchange Act. HPC also mentioned that the CFTC is working to bring on-chain trading, clearing, and settlement markets on public blockchains, including Hyperliquid, into the U.S. regulatory framework.
