[CFTC Requests Court to Dismiss CME's Lawsuit Against Kalshi Bitcoin Perpetual Futures]
Odaily Planet Daily reported that Bitcoin News posted on the X platform stating that the CFTC has requested the Washington, D.C. court to dismiss CME's lawsuit against Kalshi's Bitcoin perpetual futures. Kalshi's cash-settled BTCPERP was approved on May 29, has no expiration date, and uses a funding rate to track spot prices. CME argues that contracts without a settlement date and with continuous payments should be classified as swaps rather than futures. The CFTC, however, called this issue 'overblown' and pointed out that CME could also list similar products, noting that CME's Bitcoin futures trading volumes for June and August were both higher than in May. CME must submit a response by October 2.
