Lawyer: Can Sun Yuchen's 30 million yuan be fully reclaimed as a betrothal gift? Jianzhi Jin, a lawyer from Mankun Law Firm (@JianzhiJin), mentioned on the WuTalks Crypto podcast that whether the 30 million yuan paid by Sun Yuchen qualifies as a betrothal gift depends on whether the payment was made with the intention of marriage. The court will assess evidence such as parental involvement, proposals, transfer notes, chat records, and wedding preparations. Determining a betrothal gift does not require the couple to marry within China; as long as there is objective evidence of marriage discussions, it may be considered as intended for marriage. However, if the payment was solely for childbirth and not marriage, it would not count as a betrothal gift. Jianzhi Jin believes that if Sun Yuchen's claims are true, the amount is likely to be recognized as a betrothal gift. If the couple did not register their marriage or live together, the amount should, in principle, be fully refunded, but the final decision will still depend on evidence provided by Jing Tian.
