[Nearly 100 Catholic Leaders Jointly Oppose the 'Clarity Act,' Claiming It Weakens Regulatory Capacity to Combat Illegal Finance]
According to The Block, nearly 100 Catholic leaders have sent a letter to U.S. Senate leaders opposing Section 604 of the 'Clarity Act,' known as the 'Blockchain Regulatory Certainty Act' (BRCA). They argue that this provision could weaken regulatory efforts to combat illegal financial activities such as human trafficking. The anti-human trafficking coalition stated in the letter that innovation cannot come at the expense of human dignity and public accountability. The BRCA provision may create regulatory ambiguity and loopholes, making it harder for law enforcement to monitor illegal financial flows related to trafficking, organized crime, child exploitation, and sanctions evasion.
The controversy centers on the BRCA's establishment of a safe harbor for non-custodial developers, explicitly stating that they are not considered money transmitters. The crypto industry broadly supports this provision, arguing that it provides much-needed legal clarity for software developers and prevents innovation from moving overseas.
