In connection with the judgment of the Court of Justice of the European Union finding a breach of EU law in relation to Act LXXIX of 2021 on taking more severe action against paedophile offenders and amending certain acts for the protection of children, I reaffirm that there is broad a Hungarian national consensus on the need to ensure strict legal protection of children’s right to healthy physical, mental, and intellectual development. Following the judgment of the Court of Justice of the European Union, the national legislature must, in compliance with the principle of legal certainty, adopt legislation that, while upholding an adequate level of protection for children, ensures proper harmony between European Union law, the constitutional requirements of the Fundamental Law of Hungary, and relevant international legal obligations, thereby achieving a fair balance. To achieve this, the competent constitutional bodies, including the National Assembly and the Government, are bound by a duty to cooperate and share responsibility. I sincerely hope that the Members of Parliament from the parties elected in April, together with the incoming government, will fulfil these expectations in a manner consistent with society’s expectations.(Dr. Tamás Sulyok)
