Swan sued several former employees in September 2024, accusing them of stealing confidential documents and resigning, and just a few days later founded the "counterfeit competitor" company Proton Management; At the same time, they also convinced Tether, one of Swan's financing partners at the time, to terminate their cooperation with Swan and instead engage in business with them. It is reported that these former employees referred to the program as the 'Rain and Hellfire' program. On Monday, Swan filed a subpoena application in the Southern District Court of New York, targeting Cantor Fitzgerald and Lutnick because Swan believed they held key documents related to the failed mining project 2040 Energy, which he worked with the company and Teda, as well as employee resignations and alleged data theft. The subpoena application against Lutnik comes at a time when he is serving as the US Secretary of Commerce, and several Democratic senators, including Elizabeth Warren, are continuing to question him about potential conflicts of interest related to Teda.
