The latest draft text from the Senate Banking Committee includes provisions to protect software developers, incorporating the 'Blockchain Regulatory Certainty Act.' This act clarifies that non-custodial software developers who do not control user funds should not be considered money transmitters, thereby providing them with a clear legal safe harbor. The head of the institute described this as a major highlight and victory for the legislation.
