The potential re-examination of Roman Storm has been postponed due to a court delay.

Roman Storm's legal team and U.S. prosecutors have agreed to extend the procedural deadline, which may affect the retrial of the Tornado Cash co-founder on charges of conspiracy to commit money laundering and conspiracy to violate sanctions.

In documents submitted to the U.S. District Court for the Southern District of New York (SDNY) on Monday, Judge Katherine Failla approved a timeline agreed upon by Storm's attorneys and the U.S. government, which will delay the start of any potential retrial.

Although prosecutors did not indicate whether they intend to pursue a retrial on the two felony charges against Storm, any arrangements in this matter could be postponed until later in 2025, beyond the 70-day deadline following the "end of the initial trial."

Failla stated, "The court believes that excluding the time from now until December 18, 2025, will serve the interests of justice, allowing the defense time to consider and prepare post-trial motions that outweigh the public and defendant's interest in a speedy retrial."

On August 6, the jury found Storm guilty of conspiracy to operate an unlicensed money transmitting business related to his role in Tornado Cash—one of three felony charges he faced in court. After several days of deliberation, the jury was unable to reach a decision on the remaining charges.

Storm is expected to be sentenced soon for this charge, but as of Tuesday, no hearing has been scheduled.

Storm was indicted in the U.S. in August 2023 on charges including money laundering, conspiracy to operate an unlicensed money transmitting business, and conspiracy to violate U.S. sanctions. He has pleaded not guilty and has been out on bail since his arraignment.

The other two co-founders of Tornado Cash, Alexey Pertsev and Roman Semenov, are facing similar legal troubles as Storm.

Semenov was indicted alongside Storm in SDNY but remains at large as of the time of publication. Pertsev was convicted of money laundering in the Netherlands in 2024 and sentenced to over five years in prison. He is appealing that conviction.
