[Thailand's SEC Seeks Public Comment on Draft Rules for Digital Asset Derivatives Licenses] According to a notice released by the Thai Securities and Exchange Commission (SEC) on October 29, the agency has publicly solicited comments on a series of draft notices revising the licensing framework for derivatives businesses. These drafts cover derivatives exchanges, derivatives clearinghouses, and intermediary businesses, aiming to support the inclusion of digital assets within the scope of underlying assets recognized under the Derivatives Act. According to the proposal, digital asset operators will not need to establish a new company to apply for a derivatives business license. MediaNama reports that the proposed digital asset derivatives licenses would allow operators to engage in derivatives agency, proprietary trading, investment consulting, and investment management businesses. The license fee would be 500,000 baht, and existing digital asset exchanges, brokers, and dealers would be exempt from application and license fees. Among digital asset operators, only exchanges and brokers can apply to operate derivatives exchanges; digital asset custodians are prohibited from applying for clearinghouse licenses.
