The U.S. CFTC has countered CME Group's lawsuit over perpetual futures regulation policies in its latest court filing, stating that CME failed to prove any actual or imminent financial losses caused by the new policies. In fact, CME's cryptocurrency futures trading volume has increased following the policy adjustments. Back in May, the CFTC approved Kalshi to launch the first-ever U.S. Bitcoin perpetual futures contract and plans to regulate such products on a case-by-case basis as futures. CME, however, argues that perpetual contracts, which have no expiration date, should be classified as swaps and subject to different regulatory rules. TD Cowen analysts believe that CME may still hold an advantage in terms of standing and product classification disputes. However, as the perpetual contract market continues to expand during the litigation, even if CME ultimately wins the case, it may face greater challenges in dismantling the existing market structure.
