Regarding the sealing of minor offenses, anyone telling you they can execute this is misleading you. Of course, this matter will eventually be implemented, as the Supreme People's Procuratorate and the Supreme People's Court are already promoting this policy. However, it has not yet been fully implemented, and there are no replicable execution plans. All those on social media (short videos) claiming it has already started are either scammers, seeking traffic, or collecting your client information to sell to unscrupulous law firms. Those claiming to be able to help you with the pilot programs in three locations are all scammers.
The information gap is quite simple; just pick up your phone and call the local courts in Guangdong, Hangzhou, or Shanghai at 12368, and you will know. Once again, no one can assist you right now because the policy has not been implemented. Anyone telling you they can help is either a scammer or testing your money, at worst they might refund you, but there will definitely be costs incurred during the process, which you will have to cover. There has not been a single successful case online. If someone really tells you they can do it, you must verify thoroughly; contracts and such are often meaningless, and you need to establish a guarantee system.
How to guarantee? First, use a link through Taobao; confirm receipt only after it is done.
Second, use a joint account. A joint account means you go to the bank together to open an account, jointly deposit a sum of money, and once the matter is resolved, you go to the bank together to withdraw the money. Rest assured, any scammer would not dare to follow this process; if they disagree, let them argue.
Here’s the progress on the sealing of minor criminal records at the national level: On July 18, 2024, the 20th Central Committee's Third Plenary Session passed the "Decision of the Central Committee of the Communist Party of China on Further Deepening Reform and Promoting Chinese-style Modernization," which clearly states in item 9, section (35): a system for sealing minor criminal records should be established.
On December 26, 2024, the Supreme Court released the "Sixth Five-Year Reform Outline of the People's Courts," proposing to promote the establishment of a system for sealing minor criminal records.
On March 7, 2025, the Supreme Procuratorate's public account announced: in conjunction with judicial practice, actively promoting the establishment of a system for sealing minor criminal records.
So, I tell you not to rush; the policy is coming out, and the officials are definitely working overtime to formulate executable policies and details. This is similar to the legal processes in the crypto space, requiring meticulous refinement.
On June 27, 2025, today, the 16th meeting of the Standing Committee of the 14th National People's Congress voted to pass the newly revised "Public Security Administration Punishment Law of the People's Republic of China," which will officially take effect on January 1, 2026.
Starting January 1, 2026, this law will officially "take office," and the newly revised Public Security Administration Punishment Law clearly establishes a key system—sealing of public security violation records.
In simple terms, for those who meet the criteria for minor violations, their punishment records will be "encrypted and sealed," generally not made public, and can only be queried under case handling needs or special circumstances as stipulated by the state, with strict confidentiality required from the querying units.
This adjustment essentially gives those who "make mistakes but are willing to correct them" a chance for a "fresh start," maintaining the authority of the law while reducing long-term discrimination against minor violators in society.
However, this only pertains to public security violation records and does not mention criminal violation records, but it is a step forward, right? The remaining knowledge is just a matter of time; theoretically, it could be fully implemented by 2028.
After the implementation of the public security violation record sealing system, there are currently no detailed official query procedures specified for this system, so we still need to wait for specific implementation guidelines. Although it pertains to public security violation records, the sealing policy for minor criminal offenses will also progress quickly.
No matter how difficult it gets, do not be deceived by unscrupulous lawyers and legal consulting firms; this matter will not cost you anything once the regulations are established, and there is no information gap.
Recently, exchanges like Haijiao and Bybit have opened registration for mainland identities; I wonder if this indicates a loosening of the law.
